Welcome to FileSmuggle. These Terms of Use (“Terms”) govern your use of our file-transfer platform and services. FileSmuggle is a trading name of Tinker Trade LTD (“the Company”), a company registered in England and Wales.
 
By using FileSmuggle, you agree to these Terms. If you do not agree, stop using the Service immediately.
 
1. Purpose & Service Description
 
FileSmuggle provides high-speed, encrypted file-transfer services designed for professionals to move large data packets (“Cramming”) into secure, short-term links.
 
- FileSmuggle is NOT intended for illegal activity.
- We provide the "vessel" for transfer; we do not provide a public directory of files.
 
2. Eligibility
 
You must be at least 13 years old to use FileSmuggle. By using this service, you warrant that you have the legal capacity to enter into a binding contract under UK law.
 
3. Subscription & Payments
 
- Billing: Paid plans (Basic, Plus, Pro, Ultra) are billed monthly in advance.
- Automatic Renewal: Subscriptions renew automatically unless cancelled via your account dashboard before the next billing cycle.
- Statement Descriptor: Charges will appear on your bank or card statement as TINKERTRADE-FS.
- Refund Policy: Due to the digital nature of instant storage allocation and bandwidth delivery, all sales are final. Refunds are only issued at the Company’s discretion or where required by UK Consumer Rights Act 2015 in the event of a permanent service failure.
 
4. User Responsibilities & Prohibited Use
 
You are solely responsible for the data you "smuggle" through our platform. You agree NOT to:
 
- Upload malware, viruses, or any harmful code.
- Use the service to distribute Child Sexual Abuse Material (CSAM), extremist content, or non-consensual intimate imagery.
- Share copyrighted material for which you do not own the rights or a license.
- Attempt to bypass site security, "scrape" data, or disrupt our connection to Pushr.io or other infrastructure.
 
5. File Storage, Deletion & Encryption
 
- Temporary Nature: FileSmuggle is a transfer service, not a permanent archive. Files are automatically deleted after the expiration period defined by your plan (1 to 20 days).
- Encryption: Files are encrypted during transit (SSL/TLS).
- Data Loss: We are not liable for the loss of files. Users must maintain their own backups. Once a file is deleted (manually or via expiry), it is unrecoverable.
 
6. Copyright & DMCA (Notice and Takedown)
 
Tinker Trade LTD respects intellectual property. If you believe a file hosted on our servers violates your copyright, please contact abuse@filesmuggle.com with the specific URL. We act swiftly to remove infringing content in compliance with the Digital Millennium Copyright Act (DMCA) and UK copyright laws.
 
7. Limitation of Liability
 
To the maximum extent permitted by law, Tinker Trade LTD and FileSmuggle shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profit) arising out of your use of the service. The service is provided "AS IS."
 
8. Termination of Service
 
We reserve the right to terminate access and delete all files associated with any user found to be in violation of these Terms without notice or refund.
 
9. Governing Law
 
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
