FileSmuggle (a trading name of Tinker Trade LTD) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and the UK Copyright, Designs and Patents Act, we have implemented the following procedures for reporting alleged infringement.
 
1. The "Safe Harbor" Principle
 
FileSmuggle is a service provider. We provide automated "smuggling" (transfer) and temporary storage of data at the direction of our users. We do not monitor, review, or edit the files uploaded to our system. However, we will respond expeditiously to remove or disable access to content that is claimed to be infringing.
 
2. How to File a Takedown Notice
 
If you are a copyright owner or an authorized agent and believe that any content hosted on FileSmuggle infringes upon your copyrights, you may submit a notification to our Designated Copyright Agent at abuse@filesmuggle.com.
 
To be effective, your notice must include:
 
- Identification of the copyrighted work claimed to have been infringed.

- Identification of the material that is claimed to be infringing (you must provide the specific FileSmuggle "Tiny Link" or URL).

- Your contact information, including your address, telephone number, and email address.

- A statement of "Good Faith" that use of the material in the manner complained of is not authorized by the copyright owner.

- A statement of accuracy, under penalty of perjury, that the information in the notification is correct and that you are authorized to act on behalf of the owner.

- A physical or electronic signature of the copyright owner or authorized agent.
 
3. Our Response to Notices
 
Upon receipt of a valid and complete Takedown Notice:
 
1. We will remove or disable access to the infringing material immediately.

2. We will notify the user who uploaded the material of the removal.

3. We maintain a "Repeat Infringer Policy." Accounts found to be repeatedly uploading unauthorized content will be permanently banned and their subscriptions cancelled without refund.
 
4. Counter-Notification
 
If you believe your file was removed by mistake (e.g., you actually own the rights or have a license), you may send a Counter-Notification to abuse@filesmuggle.com. Your counter-notice must include your identification, the link that was removed, and a statement consenting to the jurisdiction of the courts of England and Wales.
 
5. Automated Protection
 
Tinker Trade LTD utilizes various automated tools to prevent the re-upload of previously flagged infringing data hashes. We are committed to maintaining a clean, professional ecosystem for creators.
